These Terms & Conditions ("Terms") govern the hire of cold plunge equipment by Deep Chill to private residential customers ("you" or "the customer"). By placing an enquiry and accepting a hire agreement, you agree to be bound by these Terms.
Deep Chill provides a fully managed cold plunge hire service for private residential properties. The service includes delivery and installation of a cold plunge tub and chiller unit, regular service visits (every 10 days), and collection at the end of the hire period.
The service is provided to home customers only. The equipment must not be used for commercial purposes.
The minimum hire period is 2 months, commencing from the date of installation. After the minimum term, the hire continues on a rolling monthly basis until either party gives notice to terminate in accordance with these Terms.
Early termination within the minimum hire period may result in the remaining balance for the minimum term becoming payable. Full details will be confirmed in your hire agreement.
The monthly hire fee is as set out in your hire agreement. A setup or delivery fee may also apply — this will be confirmed before you commit. A refundable deposit of [[DEPOSIT AMOUNT]] is required prior to installation.
Invoices are issued monthly in advance. Payment is due within [[PAYMENT TERMS, e.g. 7 days]] of the invoice date. Late payment may result in suspension of the service.
The monthly hire fee does not include the cost of electricity to run the chiller unit. This remains the customer's responsibility.
The customer is responsible for ensuring the property meets the minimum installation requirements prior to the delivery date. These will be confirmed during the suitability check. If the property is found to be unsuitable on delivery day, a failed delivery charge may apply.
All equipment supplied remains the property of Deep Chill at all times. The customer must not modify, move, sell, or sub-let the equipment. The equipment must not be used for purposes other than personal residential cold water immersion.
The customer is responsible for any damage to the equipment beyond fair wear and tear. The cost of repair or replacement for any such damage will be charged to the customer. The deposit will be retained in whole or in part where damage costs apply.
Cold water immersion carries inherent risks. It is the customer's responsibility to ensure that all users of the equipment are medically suitable for cold water immersion. Deep Chill strongly recommends seeking medical advice before use. Deep Chill accepts no liability for any injury, illness, or adverse health event arising from use of the equipment.

Deep Chill will carry out service visits every 10 days. The customer must provide access to the outdoor installation area during these visits. Where access cannot be provided, we will endeavour to reschedule within a reasonable period. Repeated failure to provide access may result in additional charges or termination of the agreement.
Either party may terminate the agreement after the minimum hire term by giving [[NOTICE PERIOD, e.g. 30 days]] written notice. Deep Chill reserves the right to terminate the agreement immediately in the event of material breach by the customer.
To the fullest extent permitted by law, Deep Chill's liability in respect of any claim arising from this agreement shall be limited to the total hire fees paid by the customer in the [[3]] months preceding the event giving rise to the claim.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Deep Chill reserves the right to update these Terms. Customers will be notified of material changes in advance. Continued use of the service following notification constitutes acceptance of the updated Terms.
